Estas condiciones regulan la venta de productos a través de la web www.mots.pro, tanto a clientes profesionales (B2B) como a consumidores finales (B2C).
La realización de un pedido implica la aceptación plena de las presentes condiciones de venta.


3. Precios

·       Los precios mostrados en la web incluyen el I.V.A. aplicable, salvo indicación expresa en operaciones B2B.

·       MOTING PARTS, S.L. se reserva el derecho de modificar los precios, ofertas o condiciones comerciales sin previo aviso, respetando los pedidos ya confirmados.


4. Formas de Pago

Las formas de pago aceptadas son:

·       Particulares: Tarjeta de crédito o débito, BIZUM


Retrasos o impagos:
En caso de retraso o impago, MOTING PARTS se reserva el derecho de suspender temporalmente el acceso a la cuenta y bloquear nuevos pedidos hasta la regularización de la situación.

Para solicitar una devolución, deberá comunicarse por escrito a [email protected] indicando número de pedido, producto y motivo de la devolución.
El producto deberá estar en su embalaje original y en perfecto estado. No se aceptarán devoluciones no autorizadas.


7. Garantías

Todos los productos cuentan con la garantía legal establecida por la normativa vigente.

·       Las reclamaciones por defecto o mal funcionamiento deberán enviarse junto con el albarán o factura y una breve descripción del problema.

·       Si la garantía es aceptada, MOTING PARTS asumirá los portes de devolución; en caso contrario, los gastos correrán a cargo del cliente.


8. Reclamaciones y Daños de Transporte

El cliente deberá revisar el estado de la mercancía en el momento de la entrega.
Cualquier incidencia o daño visible debe constar en el albarán de entrega del transportista.
No se admitirán reclamaciones pasados 5 días hábiles desde la recepción del pedido.

2. Scope of Application

These terms govern all sales made through the website www.mots.pro, both to professional customers (B2B) and final consumers (B2C).
Placing an order implies full acceptance of these terms and conditions.

3. Prices

  • All prices displayed on this website include VAT, unless otherwise stated for B2B transactions.
  • MOTING PARTS, S.L. reserves the right to modify prices, offers, or commercial conditions without prior notice, while respecting already confirmed orders.

4. Payment Methods

Accepted payment methods:
  • For retail customers: Credit/debit card, bank transfer, or PayPal.
  • For professional customers: Bank transfer, direct debit, cheque, or promissory note (according to previously agreed terms).
Authorized payment terms for professional clients are: in advance, upon delivery, 15 or 30 days, with a maximum authorized period of 30 calendar days. Late payments:
In the event of a late or missed payment, MOTING PARTS reserves the right to temporarily suspend the client’s account and block new orders until the situation is resolved.

5. Shipping and Delivery

  • Orders are processed Monday to Friday during business hours.
  • Shipments to mainland Spain and the Balearic Islands are free of charge for orders over €300 (net).
  • For smaller orders, shipping costs will be shown during checkout.
  • Deliveries are made through MOTING PARTS’ usual transport partners.
Backorders:
Items not available at the time of shipment will remain on backorder and will be shipped as soon as they are in stock, unless the customer specifies otherwise.

6. Returns and Right of Withdrawal

Return periods:
  • Retail customers (B2C): have 14 calendar days from the date of receipt to exercise their right of withdrawal, without the need to justify the decision.
  • Professional customers (B2B): may request a return within 15 days of delivery, subject to prior authorization from MOTING PARTS.
To request a return, contact us in writing at [email protected], indicating the order number, product, and reason for the return.
Returned products must be in their original packaging and perfect condition. Unauthorized returns will not be accepted.

7. Warranty

All products are covered by the legal warranty in accordance with applicable legislation.
  • Claims for defects or malfunctions must include the delivery note or invoice and a brief description of the issue.
  • If the warranty claim is accepted, MOTING PARTS will cover return shipping costs. Otherwise, the customer will bear the cost and the item will be returned with an explanation.

8. Claims and Transport Damage

The customer must check the condition of the goods upon delivery.
Any visible damage or anomaly must be noted on the transport company’s delivery slip.
No claims will be accepted after 5 working days from receipt of the goods.

9. Applicable Law and Jurisdiction

These terms and conditions are governed by Spanish law.
In the event of any dispute, the parties submit to the Courts and Tribunals of Girona (Spain), except in cases where consumer protection laws require otherwise.

En caso de conflicto, las partes se someten a los Juzgados y Tribunales de Girona, salvo disposición contraria de la normativa de protección de consumidores.
